Right of Withdrawal

Statutory withdrawal information for consumers under §312g BGB / EU Consumer Rights Directive.

This withdrawal information applies to digital services and subscriptions purchased by consumers (B2C) under §312g BGB and the EU Consumer Rights Directive (2011/83/EU). For business customers (B2B operators on Clubster Business / Business App) the statutory right of withdrawal does not apply.

§ 02

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we are informed about your decision to withdraw.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no case will you be charged any fees for this reimbursement.

§ 03

Early Expiry of the Right of Withdrawal

For digital content not provided on a tangible medium, the right of withdrawal expires if you have expressly consented to performance beginning before the end of the withdrawal period AND have acknowledged that you lose your right of withdrawal upon commencement of performance.

During checkout for paid features (e.g. Clubster Business plans, event quota packs, club boosts), an explicit checkbox confirms this consent — the right of withdrawal is then waived to enable immediate use.

§ 04

No Withdrawal for Business Customers

Pursuant to §312 (5) BGB and §312g BGB, the right of withdrawal applies only to consumers (natural persons concluding the contract for purposes outside their trade or self-employed professional activity).

Operators of clubs, bars, event venues, agencies and self-employed event managers using Clubster Business are business customers and have no statutory right of withdrawal. Cancellation rights for these customers are governed by the contract / Business Terms (monthly cancellable, no minimum term).
